What you can do if a person is arrested in Pasadena, Texas?

Pasadena bail bonds in Pasadena, Texas can be easy or in many cases very difficult depending on why the person has been arrested.

If a person is arrested in Pasadena Texas by a (Pasadena police officer) and is charged with a class A or B misdemeanor, a felony, or is arrested because of a fugitive warrant from another county or state then the person is (temporarily) detained at the Pasadena jail.

When a person is arrested for a new offense a formal complaint is filed with the District Attorney's Office by the officer. The District Attorney will then either choose to accept or deny the complaint.

If the complaint is denied then the defendant is released from that charge. If the complaint is accepted then the defendant is formally charged and a bail bond is set by the District Attorney. This process typically takes between 8 and 12 hours.

Once a person is formally charged the Pasadena jail is no longer the jail where the defendant is required to be held. All persons charged with a class A or B misdemeanor or a felony or a fugitive warrant from another county or state are required to be detained at the Harris County Jail in Houston, Texas. The Pasadena Police Department will then either transport the defendant to the Harris County Jail or Harris County will pick the defendant up and transport them to the Harris County Jail.

A small window of opportunity exists in order to try and get the defendant released from the Pasadena jail for a class A or B misdemeanor or a felony charge pending in Harris County, Texas by taking a bail bond to Pasadena. This would get the defendant released from jail within an hour after the Pasadena Bail Bond is posted. If the defendant is taken to the Harris County Jail the process of release could take an additional 8 to 24 hours or more. It is not possible to post a bail bond in Pasadena, Texas if a person has been arrested for a fugitive offense, (meaning) an open warrant deriving from a criminal charge pending in another county in Texas or another state. All persons being detained for fugitive charges must be taken to the Harris County Jail.

If a person is arrested in Pasadena by a Pasadena police officer for a class c misdemeanor (an outstanding traffic warrant in most cases) then depending on which Municipal Court or Justice of the Peace Court within Harris County that issued the warrant a hold is placed on the defendant by that court.

If the warrant is a Pasadena Municipal Court warrant the person will remain in custody in the Pasadena Jail until the person is either bailed out of jail, the fine is paid or until the defendant is taken to court. If a person remains in jail until court then if the defendant is found not guilty they are released from custody, if the defendant is found guilty then the fine must be paid or the defendant must sit out their time in jail until the fine is paid. The only other possibility would be if a judge chooses to release the defendant.

If the warrant is from another Municipality within Harris County then that police department will pick up and transport the defendant to their jail. In many cases if a defendant is being held in the Pasadena Jail on warrants from another municipal court it may be possible to get the defendant released from the Pasadena jail before they are transported to the other jail. This process requires that a bail bond be posted with the other court or the fine be paid to the other court. In order to post a bail bond with the other court the bail bond must first be taken to the Pasadena Jail and be thumb printed and signed by the person in jail, then taken to the other court or when the court is closed taken to the police department of that city. This process can be done in most courts and police departments throughout Harris County, Texas. However, it is the up to each court and police department to determine if they will allow a bail bond to be posted for their charges, if they refuse to allow for a Pasadena bail bond to be posted then the person in jail must be transported to the other jail in order to obtain their release.

If the warrant is from a Justice of the Peace Court within Harris County then in order to attempt getting the defendant released from the Pasadena jail certain circumstances must be in existence. The Justice of the Peace Court must be open in most cases. The Justice of the Peace Courts are open Monday through Friday during regular daytime business hours. There are two Precincts in Harris County where a bail bond can be posted after hours and on weekends with the Constable of those precincts; Harris County Constable Precinct 1, and Harris County Constable Precinct 5. If a person has warrants with Justice of the Peace Courts in Precinct 2,3,4,6, or 8 they must be transported to the Harris County Jail in order to be released from custody after hours and on weekends. Precinct 5 may or may not allow for a bail bond to be posted after hours depending upon if the availability of an officer at the station. Justice of the Peace bonds for Precinct 1 can be posted at the court or at the Constables office 24 hours a day.

If a person is arrested for any criminal offense in Pasadena by a Harris County Sheriff's Deputy, a Harris County Constable, or a Texas State Trooper then the defendant will be transported directly to the Harris County Jail.

All bail bonds in Pasadena Texas that require a release from the Harris County Sheriff's Department which include all Felonies, all class A and B misdemeanors, all out of county or out of state cases and the Justice of the Peace Courts not open after hours must be taken to and approved by the Harris County Sheriff's Department located at 49 San Jacinto in downtown Houston.
