What are the steps a person can take if arrested in Bellaire Texas?

If a person is arrested in Bellaire Texas by the (Bellaire Police) and is charged with anything other than a Bellaire Municipal Charge then the Bellaire jail is only going to be a temporary holding facility. A Bellaire Municipal charge is typically a traffic ticket but can be other class c misdemeanor offenses such as sign ordinances or food and beverage ordinances where a citation was issued by the Bellaire Police Department.

To be clear, a person can be arrested in Bellaire by a police agency other than the Bellaire Police Department. Harris County Constables, Harris County Sheriff Deputies and DPS officers can all make an arrest within the City of Bellaire. If one of these police agencies makes an arrest in Bellaire the person arrested is taken directly to the Harris County Jail and anything the person may be charged with is prosecuted by Harris County and not the City of Bellaire Municipal Court.

Charges that are not prosecuted in the Bellaire Municipal Court are class C misdemeanors filed in another Municipal Court or Justice of the Peace Court, all class A or B misdemeanors, all felonies and all fugitive warrants from another county or state. A common misconception is that if a person is arrested in Bellaire Texas and is taken to jail in Bellaire Texas that the person will be going to court in Bellaire Texas. As stated above the Bellaire Municipal Court only has jurisdiction over class C misdemeanor cases that derive from citations or arrests for class c misdemeanors when the arrest or citation is made by a City of Bellaire Police Officer.

This would get the defendant released from jail within an hour (typically) after the bond is presented to the Bellaire Jail. If the defendant is taken to the Harris County Jail the process of release could take an additional 8 to 24 hours or more. It is not possible to post a bail bond at the Bellaire jail if a person has been arrested for a fugitive offense, (meaning) an open warrant deriving from a criminal charge pending in another county in Texas or another state. All persons being detained for fugitive charges must be taken to the Harris County Jail.

If a person is arrested in Bellaire, Texas by a Bellaire Police Officer for a class c misdemeanor (an outstanding traffic warrant in most cases) for an outstanding warrant from another court other than the Bellaire Municipal Court then depending upon which Municipal Court or Justice of the Peace Court within Harris County that issued the warrant, a hold is placed on the defendant by that court.

If the outstanding warrant is a Bellaire Municipal Court warrant the person will remain in custody in the Bellaire Jail until the person is either bailed out of jail, the fine is paid or until the defendant is taken to court. If a person remains in jail until court then if the defendant is found not guilty they are released from custody. If the defendant is found guilty then a fine must be paid or the defendant must sit out their time in jail until the fine is paid. The only other possibility would be if a judge chooses to release the defendant.

If the warrant is from another Municipality within Harris County then that police department will pick up and transport the defendant to their jail. In many cases if a defendant is being held in the Bellaire Jail on warrants from another municipal court it may be possible to get the defendant released from the Bellaire jail before they are transported to the other jail.

This process requires that a bail bond be posted with the other court or the fine if applicable be paid to the other court. In order to post a bail bond with the other court then (A) a bail bond must first be purchased from a Harris County Bail Bond Company in Houston, Texas or (B) a cash bond posted with the court in question.

If a bail bond is purchased through a Houston bail Bond Company then the bond must be taken to the Bellaire Jail and be thumb printed and signed by the person in jail, then taken to the other court or when the court is closed taken to the police department of that city. This process can be done in most courts and police departments throughout Harris County, Texas. However, it is the up to each court and police department to determine if they will allow a bail bond to be posted for their charges, if they refuse to allow for a Bellaire bail bond to be posted then the person in jail must be transported to the other jail in order to obtain their release.

If the warrant is from a Justice of the Peace Court within Harris County then in order to attempt getting the defendant released from the Bellaire jail certain circumstances must be in existence. Precinct 5 may or may not allow for a bail bond to be posted after hours depending upon the availability of an officer at the Constables office. Justice of the Peace bonds for Precinct 1 can be posted at the court or at the Constables office 24 hours a day.

If a person is arrested for any criminal offense in Bellaire Texas by a Harris County Sheriff's Deputy, a Harris County Constable, or a Texas State Trooper then the defendant will be transported directly to the Harris County Jail.
