When a person receives a "traffic ticket" in actuality they are being given a personal recognizance bond by a law enforcement officer (cop).

A law enforcement officer has the right to arrest (detain someone), if they choose to do so and (place them into custody) or in other words take a person to jail for a traffic offense if the officer chooses to do so. There are some exceptions and to find legal answers to questions concerning traffic tickets and traffic ticket warrants contact an attorney.

When a person signs a "traffic ticket" citation they are signing a personal recognizance bond swearing that they will appear in court.

If an individual fails to appear for a court date, a warrant of arrest can be issued and usually is, and the person can be arrested and taken to jail. We are a Houston Bail Bond company and can help with questions concerning Houston Traffic Ticket Warrant Bail Bonds.

Under most circumstances, (read about a capias profine warrant below), a person cannot be sentenced to jail for a traffic offense if they are found guilty. Traffic violations in the State of Texas are class c misdemeanors and class c misdemeanors are punishable by fine only. It is important to understand the implications of failing to appear in court we would encourage you to call us for information. A Houston Bail Bond Company can be of assistance if a warrant of arrest is issued for failure to appear in court.

If a person fails to appear in court before the court has rendered a judgment of guilty or not guilty then a warrant can be issued and a bond set by the court.

The bond is an amount of money set by the court that is meant to guarantee the defendants court appearance.

A bail bond can be placed on deposit in cash (the full amount of the bond) with the court, or purchased by paying a fee to a bail bond company. The bond is used to guarantee the court appearance of the defendant for any and all court dates up to and including the initial arraignment date and all subsequent reset dates until the case is finally adjudicated, simply put, (until there is a finding by the court of innocent or guilty).

If a person appears in court and receives a judgment of guilty then typically a fine is assessed. The fine can be paid immediately or if the defendant does not have the funds available to pay the fine then the court will order some type of payment plan.

If a person fails to pay the fine according to the payment plan directed by the court or fails to appear for a court hearing concerning payment of the fine then the court will order a warrant of arrest for the defendant, this is called a (capias profine) warrant.

A capias profine warrant is not bondable. Once it has been determined by the court that a person has not met their obligations of paying a fine either by not making timely payments or by not appearing in court and requesting more time to pay, a capias profine warrant is issued. Once a capias profine warrant is issued the only options are to pay the fine in full or go to jail and receive jail credit that accumulates daily. The jail credit given can fluctuate, in other words it is possible to sit in jail and receive the minimum jail credit and therefore spend more days in jail, or receive maximum credit which usually results in an immediate release.

A warrant of arrest can be issued by the court, however there are many courts that prosecute traffic tickets in Harris County and each court handles the issuance of warrants in a different manner. Some courts allow for a grace period before a warrant is issued.
