A. JUSTICE OF THE PEACE Class C misdemeanors, these are primarily traffic ticket offenses. A Class C misdemeanor can be other minor offenses such as a minor theft, drug paraphernalia, a minor assault and others; again it depends on how a case is filed.

1. Arrest and taken directly to the Harris County Jail
2. Arrest and taken to the City of Houston Jail
3. Arrest ant taken to another municipality within Harris County i.e. small municipalities such as the City of Bellaire, the City of Pasadena, the City of Humble, etc.

(1) When someone has been arrested and is charged with a Class C misdemeanor Justice of the Peace case and taken directly to the Harris County Jail.
The person arrested will be released from the Harris County Jail within 24 hours without requiring the services of a bail bond company. It is also possible to utilize the services of a Houston bail bond company to insure the defendants release from jail; this simply comes down to personal choice. Bail bonds in Houston for Justice of the Peace Class C misdemeanors typically range from $200.00 to $500.00.

If the person remains in jail they are taken in front of a magistrate and if they plead guilty they are typically released for time served. If the defendant pleads not guilty they are typically released on a personal bond and are given a court date to appear at a later date.

The reason some choose to use the services of a bail bond company is to get the person released as quickly as possible. Once the bond is acknowledged by the Sheriff’s Department the release time for the defendant is between 6 and 12 hours or longer.

(2) When someone has been arrested and is charged with a Class C misdemeanor Justice of the Peace case and taken to the City of Houston Municipal Jail (City Jail).

Release for these cases requires a lot of running around and has time and date constraints. To be released from any jail other than the Harris County Jail for Justice of the Peace cases the bond must be signed and thumb printed by the person in jail and the bond must be taken directly to the Justice of the Peace Court. If this can be done timely then it is possible to get someone released from the City of Houston Jail when they are being held on Justice of the Peace cases.

This is always problematic because when a person has been arrested and taken to any other jail other than the Harris County Jail they are being held temporarily and are going to be transferred to the Harris County Jail. We have no control over when a person is going to be transferred to Harris County. Consequently if someone attempts to make arrangements to get a person out of any other jail other than Harris County it is possible to do a whole lot of running around only to find out that the person has been transferred to Harris County somewhere in between and their running around was for nothing.

The Justice of the Peace Courts are only open Monday through Friday and are typically open between 8am and 5pm. To be released from jail on Justice of the Peace cases after 5pm and on weekends is only done after a person has been transferred to the Harris County Jail. The release for these types of cases can only be obtained from the Harris County Bonding Department at 49 San Jacinto when the Justice of the Peace Courts are closed and Harris County will not accept a bail bond or authorize a release for someone that is in any other jail; the person must be transferred to Harris County.
So, if attempting to get a person out of the City Jail is desired then the process would be to first go to a bail bond company in Houston. A person would need to be in a bail bondsman’s office no later than 12:00 in the afternoon. To attempt to post Justice of the Peace bonds for someone in the City Jail any later would probably be too late.

After you get a bail bond or bail bonds from a bail bond company you then have to take the bond(s) to the City Jail in order to get the person in jail to sign and thumbprint the bond(s).
After the bonds have been signed and thumb printed by the person in jail then the bonds must be taken to the specific Justice of the Peace Court where the warrant is being held in order to obtain release. The Justice of the Peace Courts are scattered all over Harris County. If a person has Justice of the Peace cases in more than one Justice of the Peace Court then that means they could be driving all over Houston form one court to the next, all in hopes of getting the bond(s) posted before the person gets transferred to the Harris County Jail.

All of this is important to understand because if the person gets transferred to the Harris County Jail then there’s a very good possibility that the person will be taken in front of a 24 hour magistrate after being booked into the Harris County Jail and then released either for time served or on a personal recognizance bond which means all of your efforts will have been for nothing and the bail bond company will probably charge a fee for their services regardless of what happens.

(3) When a person has been arrested and taken to another municipality within Harris County i.e. small municipalities such as the City of Bellaire, the City of Pasadena, the City of Humble, etc.
